Hip-hop star Nelly was sued for illegal use the name of his clothing range Vokal Clothing Co. by the two Florida men, who released two singles under the name of Vokal in 90s.
The multi-platinum rapper and fashion designer Nelly sang in his song about his Vokal Clothing Co.: ‘Warm, sweatin’ it’s hot up in this joint Vokal tanktop, all on at this point,’ and one of the Florida singers, Camaron Caines, heard this song with the name of his group.
The fashion clothing line Vokal Clothing Co. was launched in November 2001, and it got $20 million from sales during the first eight months of operations since the introduction, its lawyers said according to kansascity.com.
Nelly tries to defend himself claiming that the musicians from Florida, Camaron Caines together with his partner Tai Wilson, have never used the name to sell clothing. The singers, meantime, claim that they pronounce the word “vokal” with the stress on the second syllable as well as Nelly does.
But one more trouble is waiting for Nelly. His insurance company, which is paying for the court case is not sure whether it should pay for him or not, because Nelly's insurance policies don't require insurers to pay for his defense in the trademark case.
