LA prosecutors announced Wednesday (February 2) that they will not file charges against Paris Hilton who allegedly picked up a copy of her notorious sex tape from the newsstand in West Hollywood without paying for it. Hilton could face accusations of petty theft and vandalism, but the county district attorney’s office dropped charges against her for lack of evidence.

Although the security video from the Swing News store appeared to show the “Simple Life” star reaching out for the copy of her X-rated tape and putting it in her bag, Irene Wakabayashi of the district attorney’s office said the presented evidence “is not of such convincing force that a reasonable and objective jury would unanimously agree that the suspect is guilty."

The Swing News employee Jerry Castro, said Hilton, who visited the store on December 15 was amiable at first but became furious when she saw that the store had her videos and had posters advertising them.

“She was using profanity to the ultimate. She threw her 80 cents change at me and took the video and said, ’ I’m taking this and I’m not buying it’ “  said Castro.

Hilton who never wanted the infamous video titled “One Night in Paris” become public, said she was embarrassed and humiliated when it happened in 2003, just before the start of her “Simply Life” series.
